Defective Product: Preserve the Evidence

Individuals are injured or killed daily due to defective products.  Products we use every day may be defective in many different ways. Iowa recognizes product liability claims for defective design, manufacturing error, or a failure to warn theory.  This means that you must prove that the product was either improperly designed, built, or that it included inadequate (or no) warnings or instructions.

A product liability claim can compensate you for injury or wrongful death caused by a defective product, but there are important steps that need to be taken in the process.  Should a product cause harm to you or a loved one, it is important to remember to attempt to preserve the product in its condition at the time it caused the injury.

  • Do NOT tamper with the product that caused serious injury.
  • Keep it in the state in which it caused damage.
  • Seek an attorney as soon as possible; it often takes an attorney to have equipment set aside or a scene of an accident preserved.  We will often want to have an expert come to the scene to inspect the accident scene or the product to help determine what happened and why it happened.
