Kirkland v. Soo Railroad (Iowa 1993)

Facts: Our client was a passenger in a vehicle that attempted to cross a railroad crossing that did not have electric signals or any other warning system present. The automobile was struck by an oncoming train that the driver did not see. The case was based on a negligent failure to warn and negligent failure to have adequate lighting. The facts of the case were later portrayed on the television show, Rescue 911.
